In most cases, only the “personal representative” of the deceased person can file a claim for compensation on behalf of those who lost a loved one.
Pennsylvania law says a representative may take action when: “If no person is eligible to recover damages under subsection (b), the personal representative of the deceased may bring an action to recover damages for reasonable hospital, nursing, medical, funeral expenses and expenses of administration necessitated by reason of injuries causing death.”
The personal representative is usually appointed in the deceased person’s will or by the court if there is no will. A wrongful death claim is typically filed on behalf of the surviving family members and beneficiaries to seek compensation for the losses they have suffered due to the wrongful death of their loved one.

“What should I do if I experience health problems?”
First, seek medical treatment if you are developing health symptoms. Second, consider getting a baseline of your entire health, like blood tests and organ function, in case anything changes. And there are other steps you can take to improve your chances of securing compensation, like preserving evidence. Take photographs or videos of anything involved that you think led to your injury.
It is also important to be careful about what you sign or what you say to companies involved in your injury. They are trying to limit their liability and may try to get you to sign documents or make statements that hurt your case. To ensure your rights are protected in your state consult with an experienced attorney first.
